These Terms and Conditions are the standard terms and conditions that apply to the sale of Goods by us, ABMM Ltd, a company registered in England and Wales under company number 08439448, whose registered address is:

1. Definitions and Interpretation
1.1 In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:
Consumer means a consumer as defined in the Consumer Rights Act 2015.
Contract means the contract for the purchase and sale of the Goods, as explained in Clause 3.
Customer means you, the individual placing an Order with us.
Goods means the adult products, accessories and related items supplied by us as specified in your Order and confirmed in our Delivery Confirmation.
Order means your order for the Goods.
Order Confirmation means our acknowledgement that we have received your Order.
Delivery Confirmation means our confirmation that your Order has been accepted and processed for dispatch.
Website means the Godemiche website and any associated domains operated by ABMM Ltd.
1.2 References to "writing" and "written" include email and other electronic communications.
2. Access to and Use of Our Website
2.1 Access to our Website is provided free of charge.
2.2 It is your responsibility to make any arrangements necessary to access our Website.
2.3 Access to our Website is provided on an "as available" and "as is" basis.
2.4 We may alter, suspend or discontinue all or part of our Website at any time without notice.
2.5 We shall not be liable if our Website becomes unavailable for any period of time.
2.6 Use of our Website is subject to our Website Terms of Use and Privacy Policy.
2.7 By using this Website and purchasing Goods from us, you confirm that:

You are legally entitled to purchase and possess adult products in your jurisdiction;

3. The Contract
3.1 These Terms and Conditions govern the sale of all Goods by us and form the basis of the Contract between you and us.
3.2 Our Website will guide you through the ordering process. You may check out as a guest or create an account.
3.3 Before submitting your Order, you will be given the opportunity to review and amend it. You are responsible for ensuring all information provided is accurate.
3.4 No part of our Website constitutes a contractual offer capable of acceptance. Your Order constitutes an offer to purchase Goods from us.
3.5 Once your Order has been submitted, we will send an Order Confirmation acknowledging receipt of your Order. This acknowledgement does not constitute acceptance of your Order.
3.6 A legally binding Contract is only formed when we issue a Delivery Confirmation confirming that your Goods have been accepted and processed for dispatch.
3.7 Delivery Confirmations will include:

3.8 It is your responsibility to provide a valid email address, telephone number and delivery address.
3.9 We cannot be responsible for non-delivery of emails resulting from incorrect contact information supplied by you.
3.10 If we are unable to accept or fulfil your Order, any payment received will be refunded within 14 days.
3.11 You may request cancellation of your Order at any time before it has been fulfilled, entered production, or dispatched.
3.12 Where production of a made-to-order, personalised or customised product has already begun, cancellation may not be possible and any refund may be reduced to reflect materials, labour and customisation costs already incurred, where permitted by applicable consumer protection laws.
4. Description and Specification of Goods
4.1 We make every reasonable effort to ensure that product descriptions, photographs, dimensions and specifications are accurate.
4.2 Product photographs are provided for illustrative purposes only.
4.3 Colours may appear differently depending on monitor, mobile device or tablet settings.
4.4 Many of our products are handmade and made to order. Minor variations in colour, finish, dimensions and appearance may occur and do not constitute faults.
4.5 Product measurements shown on our Website are approximate and may vary slightly.
4.6 Where sizing guides are provided, they are intended as guidance only.
4.7 We reserve the right to make changes to product specifications where necessary to comply with legal, regulatory or safety requirements.
4.8 We may make minor changes to products that do not materially affect their quality, functionality or intended use.
5. Price and Payment
5.1 The price of the Goods will be the price shown on our Website at the time your Order is placed.
5.2 All prices are displayed in Pounds Sterling (£GBP).
5.3 Prices include VAT where applicable.
5.4 Delivery charges are shown separately during checkout.
5.5 We reserve the right to amend prices at any time, although changes will not affect Orders already accepted.
5.6 We take reasonable care to ensure pricing information is accurate.
5.7 If a pricing error is obvious and unmistakable, we will not be obliged to supply Goods at the incorrect price.
5.8 Payment must be made in full at the time of placing an Order.
5.9 Payments are processed securely through third-party payment providers.
5.10 We do not store complete payment card details.
5.11 Promotional codes:

Have no cash value;
-
Cannot be sold or transferred;
-
May be subject to expiry dates and restrictions;
-
Cannot normally be combined with other promotions unless stated otherwise.
5.12 If payment authorisation cannot be obtained, we may suspend or cancel your Order.
5.13 We shall not be responsible for delays resulting from incorrect payment information supplied by you.
6. Gift Cards
6.1 Gift Cards may be purchased through our Website.
6.2 It is your responsibility to obtain any necessary consent before providing a recipient's details for the purpose of issuing a Gift Card.
6.3 Gift Cards are non-refundable except where required by law.
6.4 Gift Cards cannot be exchanged for cash.
6.5 Gift Card codes are valid for 12 months from the date of issue unless otherwise stated.
6.6 We are not responsible for lost, stolen, shared or unauthorised use of Gift Card codes.
7. Lifetime Guarantee
7.1 Selected handmade silicone products sold by us are covered by our Lifetime Guarantee.
7.2 Subject to the terms of this Guarantee, we warrant that covered products will be free from defects in materials and workmanship for the lifetime of the product under normal intended use.
7.3 If a manufacturing defect arises during the lifetime of the product, we may, at our discretion:

Repair the product;
-
Replace the product with the same or a substantially similar product; or
-
Provide an alternative remedy where repair or replacement is not reasonably possible.
7.4 To qualify for the Lifetime Guarantee:
-
The product must have been used in accordance with our instructions and intended purpose;
-
The product must not have been modified, altered or repaired by anyone other than us;
-
The product must have been properly maintained and cleaned;
-
The defect must not be the result of misuse, accidental damage, neglect, improper storage, or normal wear and tear.
7.5 The Lifetime Guarantee does not affect your statutory rights.
7.6 We reserve the right to request photographs or return of the product for inspection before approving a claim.
8. Delivery
8.1 Delivery times shown on our Website are estimates only unless otherwise expressly stated.
8.2 Handmade and made-to-order products may require production time before dispatch.
8.3 Delivery times may be affected by circumstances outside our reasonable control.
8.4 Orders shipped within the United Kingdom may require a signature upon delivery.
8.5 It is your responsibility to provide complete and accurate delivery information.
8.6 If a parcel is returned to us due to incorrect or incomplete address details supplied by you, additional delivery charges may apply before the parcel can be re-shipped.
8.7 If nobody is available to receive the Goods, the courier may leave instructions regarding redelivery or collection.
8.8 If Goods are returned to us because delivery could not be completed and we are unable to contact you after reasonable attempts, we may treat the Contract as cancelled and refund the purchase price less any unrecoverable delivery or return costs incurred by us.
8.9 Delivery is deemed complete when the Goods are delivered to the address specified in your Order and physical possession is taken by you or a person identified by you.
8.10 Risk in the Goods passes to you upon delivery.
8.11 Ownership of the Goods passes to you only when we have received payment in full.
9. International Delivery
9.1 International Orders may be subject to customs duties, taxes, import fees or similar charges imposed by the destination country.
9.2 Such charges are your responsibility unless otherwise stated.
9.3 You are responsible for ensuring that the Goods may legally be imported, possessed and used in your destination country.
9.4 We are not responsible for delays, inspections, seizures or restrictions imposed by customs authorities or other governmental agencies.
10. Faulty, Damaged or Incorrect Goods
10.1 By law, we must provide Goods that are of satisfactory quality, fit for purpose, as described at the time of purchase, and in accordance with any pre-contract information we have provided.
10.2 If any Goods you have purchased are faulty, damaged upon arrival, or if you receive incorrect Goods, please contact us as soon as reasonably possible at Sales@g-silicone.com.
10.3 Where possible, please provide:

A description of the issue;

Photographs of the Goods;
-
Any information reasonably required to investigate the issue.
10.4 Beginning on the day you receive the Goods, you may have statutory rights under the Consumer Rights Act 2015, including the right to reject faulty Goods within 30 days of delivery and receive a full refund where applicable.
10.5 If you choose not to reject the Goods, or if the 30-day rejection period has expired, you may be entitled to a repair or replacement.
10.6 We will bear reasonable costs associated with any approved repair or replacement.
10.7 Where repair or replacement is impossible, unavailable or disproportionate, we may instead offer a refund or price reduction in accordance with applicable consumer legislation.
10.8 If, following repair or replacement, the Goods still fail to conform to the Contract, you may be entitled to further remedies under consumer law.
10.9 You will not be entitled to claim under this section where:

We informed you of the defect before purchase;

The issue results from misuse, neglect, accidental damage, improper storage or normal wear and tear;
-
The Goods have been modified or altered without our approval;
-
The issue results from use of the Goods in a manner for which they were not intended.
10.10 Where Goods are confirmed as faulty, damaged or incorrectly supplied, we will be responsible for the reasonable costs of return.
10.11 Any intimate products returned for inspection should be thoroughly cleaned before return.
10.12 Refunds approved under this section will normally be processed within 14 days of confirmation.
10.13 Refunds will be made using the original payment method unless otherwise agreed.
11. Cancelling and Returning Goods if You Change Your Mind
11.1 Order Cancellations Before Fulfilment
You may cancel your Order for any reason at any time before it has been fulfilled, entered production, or dispatched.
To request cancellation, please contact us as soon as possible.
If payment has already been taken, any refund due will be processed within 14 days.
11.2 Your Right to Cancel After Delivery
If you are purchasing as a Consumer, you have the legal right to cancel your Contract within 14 calendar days without giving a reason.
The cancellation period expires 14 calendar days after:

The day on which you (or a person nominated by you) receive the Goods; or
-
Where Goods are delivered in multiple shipments or instalments, the day on which you (or a person nominated by you) receive the final item, shipment or instalment of the Order.
If the final day of the cancellation period falls on a weekend or public holiday, the cancellation period will automatically extend to the next working day.
11.3 Exercising Your Right to Cancel
To exercise your right to cancel, you must notify us before the cancellation period expires.
You may do so by email, through our Website contact form, or by any other clear written communication.
Your cancellation will be deemed received on the date it is sent.
11.4 Exceptions to the Right to Cancel
For health protection, hygiene and safety reasons, the right to cancel does not apply where:

Goods have been personalised, custom-made, made-to-order or manufactured to your specifications;
-
Sealed Goods supplied for hygiene reasons have been unsealed after delivery;
-
Goods have been used after delivery where their nature makes them unsuitable for return;
-
Any other exemption applies under applicable consumer protection legislation.
Nothing in this section affects your rights relating to faulty, damaged or incorrectly supplied Goods.
11.5 Returning Goods

Unless Goods are faulty, damaged or incorrectly supplied, you are responsible for the direct cost of returning the Goods.
We do not charge restocking fees for standard returned Goods. However, where Goods have been custom-made, personalised, manufactured to your specifications, or where production has already commenced at your request, any refund may be reduced to reflect customisation costs, materials used, and labour or production time already incurred before cancellation or return, where permitted by applicable consumer protection laws.
We recommend using a tracked delivery service as returned Goods remain your responsibility until received by us.
11.6 Refunds
Refunds will be processed within 14 days of:

The day we receive the returned Goods;
-
The day you provide evidence that the Goods have been returned; or
-
Where cancellation occurs before dispatch, the day you notify us of cancellation.
Refunds will include the original standard delivery charge paid by you.
Additional charges for premium, express or upgraded delivery services are non-refundable.
Refunds may be reduced to reflect any loss in value resulting from handling beyond what is reasonably necessary to establish the nature, characteristics and functionality of the Goods.
Refunds will be made using the same payment method used for the original transaction unless otherwise agreed.
12. Cancellations by Us
12.1 We may cancel your Order at any time before dispatch if:

The Goods are no longer available and cannot reasonably be restocked;

An error has occurred in pricing, product descriptions, specifications or other information displayed on our Website;
-
We reasonably suspect fraudulent activity, unauthorised payment or a breach of these Terms and Conditions;
-
An event outside our reasonable control prevents us from fulfilling the Order.
12.2 If we cancel your Order after payment has been received, any sums paid will be refunded in full within 14 days.
12.3 Any cancellation by us will be confirmed in writing.
12.4 Where an Order contains made-to-order, personalised or custom products and production has already commenced, we reserve the right to deduct any costs already incurred for materials, labour and customisation work where permitted by applicable law.
13. Our Liability
13.1 We will be responsible for any foreseeable loss or damage that you may suffer as a result of our breach of these Terms and Conditions or our negligence.
13.2 Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by both you and us at the time the Contract was formed.
13.3 We shall not be liable for any loss or damage that is not foreseeable.
13.4 We shall not be liable for defects, damage or deterioration arising from:

Normal wear and tear;

Misuse or improper use of the Goods;
-
Failure to follow any instructions supplied with the Goods;
-
Negligence or accidental damage;
-
Improper storage;
-
Unauthorised modification, repair or alteration of the Goods.
13.5 Nothing in these Terms and Conditions excludes or limits our liability for:

Death or personal injury caused by our negligence;

Fraud or fraudulent misrepresentation;

Any matter for which it would be unlawful to exclude or limit liability.
13.6 Nothing in these Terms and Conditions affects your statutory rights as a Consumer.
14. Events Outside of Our Control (Force Majeure)
14.1 We shall not be liable for any failure or delay in performing our obligations under these Terms and Conditions where such failure or delay results from circumstances beyond our reasonable control.
14.2 Such circumstances may include, but are not limited to:

Industrial disputes;

Failure of suppliers or subcontractors;

Internet or telecommunications failures;

Power outages;
-
Fire;
-
Flood;
-
Storm;
-
Earthquake;
-
Epidemic or pandemic;

Acts of terrorism;

Civil unrest;

Government action;

War;

Natural disasters; or
-
Any other event beyond our reasonable control.
14.3 If an event outside our reasonable control continues for an extended period, we may cancel affected Orders and provide a refund for any Goods that have not been supplied.

17.3 You may not transfer, assign, charge or otherwise dispose of your rights or obligations under these Terms and Conditions or any Contract without our prior written consent.
18. Third Party Rights
18.1 These Terms and Conditions and any Contract are between you and us only.
18.2 No person who is not a party to the Contract shall have any right to enforce any term of the Contract under the Contracts (Rights of Third Parties) Act 1999.
18.3 Nothing in this clause affects any right or remedy available to a third party that exists independently of that Act.
19. Severance
19.1 If any provision of these Terms and Conditions is found by any court or competent authority to be unlawful, invalid or unenforceable, that provision shall be deemed severed from the remainder of these Terms and Conditions.
19.2 The remaining provisions shall continue in full force and effect.
19.3 Where any invalid provision could be modified to make it valid and enforceable, it shall be deemed modified to the minimum extent necessary to make it enforceable.
20. Waiver
20.1 No failure or delay by us in exercising any right, power or remedy under these Terms and Conditions shall operate as a waiver of that right, power or remedy.
20.2 No waiver by us of any breach of these Terms and Conditions shall constitute a waiver of any subsequent breach of the same or any other provision.
20.3 Any waiver must be made expressly and in writing to be effective.
21. Governing Law and Jurisdiction
21.1 These Terms and Conditions and any Contract between you and us shall be governed by and construed in accordance with the laws of England and Wales.
21.2 Any dispute, claim or matter arising out of or in connection with these Terms and Conditions or any Contract shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
21.3 Nothing in these Terms and Conditions shall limit any mandatory rights available to Consumers under applicable law.
